Former UFC Heavyweight Champion Cain Velasquez’s son, Cain Jr., was allegedly molested by Harry Goularte, in February of 2022.
Goularte, who pleaded not guilty to the charges in June of 2022, will now stand trial after a ruling made in a Santa Clara County, California court room by Judge Javier Alcala. Cain Jr. appeared at a preliminary hearing this past Monday, where he testified after non-essential members of the court were removed from the courtroom.
MMA Junkie reports that Deputy DA Robert Philbrook reportedly attempted to ask just “yes” or “no” questions to Cain Jr., who was also allowed to color in a coloring book while answering questions. Cain Jr.’s mother and father were in the courtroom during the questioning, but they were not allowed to help their son answer questions in any fashion.
There was a 15 minute break in the questioning after Cain Jr. began crying, but Cain Jr. would then touch a stick figure drawn by Philbrook to show where Goularte allegedly touched him, which was the stick figure’s penis area. Goularte allegedly molested Cain Jr. at a daycare center that was run by Patricia Bender, who is Goularte’s mother.
Stephen DeFlippis, who is Goularte’s defense attorney, was able to question Cain Jr. and he got Cain Jr. to admit that Goularte allegedly touched him twice, instead of the “100 times” that Cain Jr. previously stated. DeFlippis also admitted that his parents helped him with his testimony before taking the trial, as well as what would go down in the courtroom during his testimony.
Michelle Velasquez, who is Cain Jr.’s mother, took the stand after a lunch recess and revealed that Cain Jr. told her and Cain Sr. that Goularte put Cain Jr.’s penis in his mouth. Cain Jr. also told his mother that he saw Goularte take two more kids into the daycare bathroom, but no other alleged victims have come forward at this time.
Goularte’s mother also testified at the hearing, stating that Goularte did visit the daycare at times, but was never an employee at the daycare. Guolarte’s mother also revealed a past incident in which Guolarte placed Cain Jr. in a garbage can after Cain Jr. allegedly made fun of him. Goularte’s mom also testified that Cain Sr. had threatened to put Guolarte in a garbage can for the incident, but never followed through on the threat.
Cain Sr. was not called to the stand during the hearing and Goularte will be back in court on March 13 for a trial setting.
